PUBLIC NOTICE is hereby given to all persons concerned that on the 15th day of September, 2021 at 7:00 p.m., in the City Council Chambers of the Municipal Building, at 100 North Island Avenue, Batavia, Illinois, the Plan Commission of the City of Batavia will meet and a Public Hearing will be held pursuant to Chapters 3.1, 5.2, 5.3, 5.7, and 5.8 of the Batavia Zoning Code (City Code Title 10) to consider amending the Comprehensive Plan Land Use Map, and the Official Zoning Map to include a Planned Development Overlay District.  At the same time, the Plan Commission will hold an open meeting to consider Design Review and preliminary plat of subdivision of property.  All actions are for property proposed to be annexed to the City of Batavia located at 2500 McKee Street, Batavia, Illinois (PIN 12-17-400-006) and 37W330 McKee Street, Batavia, Illinois (PIN 12-17-400-005).  

The applicant for all actions is Pulte Home Company, LLC, 1900 E. Golf Rd, Suite 300, Schaumburg, IL 60173, contract purchaser of the property. The applicant proposes to amend the Comprehensive Plan Land Use Map for the subject properties from the current Residential >.5-2 Dwelling Units to the Acre, Residential >3.5-5 Dwelling Units the Acre, and Parks and Open Space to Residential >3.5-5 Dwelling Units the Acre and Parks and Open Space. The applicant proposes to amend the Zoning Map for the subject properties from R0 Single Family Residential (after annexation) to R1-M Single Family Residential and POS Parks and Open Space, with a Planned Development Overlay District.  The Planned Development Overlay District, Design Review, and preliminary plat of subdivision propose a 163-unit single-family residential development with public park open space. 

Pursuant to Governor Pritzker’s Executive Orders in effect when publication of this legal notice was requested, the Plan Commission meeting at which this advertised Public Hearing is to occur may be conducted solely virtually via electronic means. The meeting’s agenda will be posted a minimum of 72 hours before the meeting at: and the posted agenda will provide instruction on how one may attend and participate in the virtual meeting and public hearing.  Public comments may also be e-mailed to prior to the meeting for entry into the hearing public record.

Information regarding these applications is available for review at the Community Development Department in the City of Batavia Municipal Building during normal business hours.  You may contact the Community Development Department at 630-454-2700 for additional information. 

All interested persons, and in particular, the owners of the subject properties and adjacent and adjoining property owners, are requested to attend said Hearing.
